Architect

Paul the Architect
Situation

Paul, left firm in 2001 where he had been an employed architect for 8 years to set up on his own.

Provided services to his old firm on a sub-contract basis.

Problem Issues

Claim made against Paul’s old firm by a client for which Paul had acted while employed and continued to act on a sub-contract basis.

The claim was redirected against Paul.

The contractual relationships were not properly documented and both sets of insurers denied responsibility.

Consequences

Paul was advised, by an inexperienced solicitor, to admit liability and settle.

Money raised on the equity of his home to pay the claim contributing also to breakdown of his marriage.

PIB Solutions

PIB would have sought to prove that the ex firm was contractually bound to the client and that the work was carried out while Paul was an employee.

If successful OK. If not, the PIB contingent insurance would cover the cost.
